This policy applies to personal information we collect through:

• marketxero.com and related pages on this website
• The MarketXero customer portal at portal.marketxero.com
• Email, support, and waitlist forms operated by MarketXero
• Licensing and subscription flows connected to our indicators

This policy does not govern third-party platforms you choose to use alongside MarketXero, including NinjaTrader, your broker or data feed, Discord, YouTube, or social networks. Those services have their own privacy policies.

We collect only the information needed to operate our business, deliver software, bill subscriptions, and support customers.

Account and licensing information. When you create a portal account or subscribe, we may collect your name, email address, NinjaTrader account ID used for licensing, subscription status, product activations, and support history. We use your NinjaTrader ID to validate licenses. We never ask for your NinjaTrader password.

Billing and payment information. Subscriptions are processed by Stripe. Stripe collects and processes payment card or wallet details directly. We receive limited billing data from Stripe, such as customer ID, payment status, invoice history, and the last four digits of a card when applicable. We do not store full payment card numbers on our servers.

Authentication data. Portal sign-in is handled by our authentication provider. We receive account identifiers, email address, and basic profile fields needed to secure your account.

Communications you send us. If you email support, join a waitlist, or contact us through forms on this site, we collect the information you provide, such as your email address, message content, and any attachments or troubleshooting details you choose to share.

Website and device data. When you browse marketxero.com, we and our hosting/analytics providers may automatically collect technical data such as IP address, browser type, operating system, referring URL, pages viewed, timestamps, and general device or connection information. This helps us keep the site secure, measure performance, and understand how visitors use our pages.

Marketing preferences. If you opt in to product updates, launch announcements, or waitlists, we collect your email address and related list preferences. You can unsubscribe from marketing emails at any time.

We use personal information for legitimate business purposes, including:

• Creating and maintaining your portal account
• Activating, validating, and delivering NinjaTrader indicators
• Processing subscriptions, trials, renewals, refunds, and billing disputes
• Providing customer support and responding to requests

We do not use your information to provide investment advice, execute trades, or access your brokerage account.

Our indicators run locally inside NinjaTrader on your machine. In normal use, MarketXero does not receive your chart data, order flow, trade history, account balances, open positions, or other live trading activity from NinjaTrader unless you voluntarily send that information to us for support.

We do not collect:

• NinjaTrader passwords or broker login credentials
• Live market data streams from your charts
• Order placement or execution data from your trading account
• Government ID numbers, except where required for a specific legal or billing process you initiate

If you include trading screenshots or logs in a support request, we treat that content as support correspondence and retain it only as long as needed to resolve the issue.

We use cookies and similar technologies to operate the website, remember preferences, preserve first-touch and last-touch UTM attribution, measure traffic, and improve performance.

Essential cookies help the site function, maintain security, and support sign-in flows where applicable.

Analytics and performance cookies help us understand how visitors use the site and how pages perform. Our site uses Vercel Analytics, Vercel Speed Insights, and PostHog for aggregated usage, funnel, replay, path, and performance measurement. Session replay is limited to public MarketXero marketing, docs, legal, and Learn pages. We do not intentionally record portal authenticated pages, payment-sensitive screens, raw form message bodies, NinjaTrader usernames, or payment card data in analytics.

Third-party cookies may be set when you follow links to external services such as Discord, YouTube, Stripe checkout, or the customer portal. We do not control cookies placed by those services.

Most browsers let you block or delete cookies. You may also opt out of MarketXero analytics capture by emailing contact@marketxero.com with the subject line "Analytics Opt Out" or by using any opt-out control we make available on the website. If you disable cookies, some site features may not work as intended.

We use trusted vendors to help us run MarketXero. They may process personal information on our behalf only as needed to provide their services. Current categories include:

• Hosting and infrastructure — Vercel and related cloud providers that serve marketxero.com and connected APIs
• Authentication — Clerk or equivalent identity services for portal account security
• Payments — Stripe for subscription billing and payment processing
• Analytics and product experience — PostHog for website analytics, funnels, public-page session replay, and user path analysis
• Email and marketing automation — Loops for marketing profiles, consented email flows, waitlists, and event-triggered communications
• Customer support and operations tools — systems we use to track support requests and service delivery

We require service providers to protect personal information and use it only for the services they perform for us, subject to their own privacy policies for data they control directly.

We do not sell your personal information. We do not share it for cross-context behavioral advertising.

We may disclose information in these situations:

• Legal compliance — when required by law, regulation, legal process, or government request
• Protection of rights — to investigate fraud, security incidents, abuse, or violations of our terms

• While your account or subscription is active

When information is no longer needed, we delete it or de-identify it, except where backup copies may persist for a limited period as part of routine security and disaster-recovery practices.

We use administrative, technical, and organizational measures designed to protect personal information, including access controls, encrypted connections where appropriate, and vendor security reviews for critical systems such as authentication and payments.

No online service can guarantee absolute security. You are responsible for keeping your portal credentials confidential and using a unique password that is not reused from NinjaTrader or your broker.

Depending on where you live, you may have rights to:

• Access the personal information we hold about you
• Correct inaccurate information
• Delete certain information, subject to legal and contractual exceptions
• Opt out of marketing emails
• Restrict or object to certain processing
• Receive a portable copy of information you provided to us

Categories collected. In the preceding 12 months, we may collect identifiers (such as name and email), commercial information (subscription and purchase history), internet or network activity (website usage data), and inferences drawn from the above to support customer service and product operations.

Business purposes. We use these categories for the purposes listed in this policy, including account management, billing, security, support, analytics, and marketing with consent.

Sale or sharing. MarketXero does not sell personal information and does not share it for cross-context behavioral advertising.

Your California rights. Subject to legal exceptions, California residents may request access, deletion, and correction of personal information, and may opt out of sale/sharing (not applicable here because we do not sell or share for targeted advertising). We will not discriminate against you for exercising these rights.

Authorized agents. You may designate an authorized agent to submit a request on your behalf. We may require proof of authorization and direct verification from you.

MarketXero products and services are intended for adults who trade or evaluate trading software. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us personal information, contact us and we will take steps to delete it.

MarketXero LLC is based in the United States. If you access our services from outside the U.S., your information may be processed in the United States or other countries where our service providers operate. Those countries may have data-protection laws that differ from the laws where you live.

Our website links to third-party services such as Discord, social media platforms, Stripe checkout, NinjaTrader resources, and the customer portal. This Privacy Policy does not apply to those third-party sites or services. Review their privacy policies before providing personal information to them.
